SiteSurely helps agencies and teams monitor customer-designated websites and review recorded observations. These Terms describe the permitted use of that service and the responsibilities that come with it.
1. Acceptance of these Terms
These Terms of Service govern access to and use of SiteSurely, including the SiteSurely website-monitoring application and related services. By accessing or using SiteSurely, you agree to these Terms. If you use SiteSurely for an organization, agency, or other business, you represent that you are authorized to accept these Terms on its behalf.
If you do not agree to these Terms, do not use SiteSurely. These Terms should be read together with the SiteSurely Privacy Policy, available at /privacy, which explains information processing practices. These Terms are a repository-generated production draft and are not legal advice or a substitute for review by qualified counsel.
2. The SiteSurely service
SiteSurely is a business website-monitoring and operational-record service intended for agencies and teams. Depending on the configuration and plan, SiteSurely may monitor customer-designated websites, execute configured checks, record observations, generate evidence and screenshots where applicable, create findings and incident records, produce factual reports, and send service notifications.
SiteSurely is a monitoring tool. It does not guarantee detection of every outage, defect, conversion failure, security problem, or other change; uninterrupted monitoring or notification delivery; error-free operation; or preservation of every observation indefinitely. SiteSurely records observed results and does not guarantee a particular business, revenue, availability, security, or compliance outcome.
3. Accounts and organizations
A SiteSurely user account may be associated with one or more organizations or workspaces. Organizations can have owners, administrators, members, and viewers with different levels of access. Owners and administrators may manage organization membership, invitations, billing, and other workspace settings as supported by the application.
You are responsible for providing accurate account information, protecting your credentials, and ensuring that people using your account or organization access are authorized. Do not share credentials in a way that defeats the service's access controls. Organization administrators are responsible for managing authorized members and the permissions they provide.
4. Authorized website monitoring
You may add a website to SiteSurely only if you own it, operate it, manage it for a customer with permission, or otherwise have authority to configure or monitor it. You are responsible for obtaining and maintaining any permissions, notices, or approvals required for the websites and systems you designate.
SiteSurely does not grant you permission to monitor, access, test, or interfere with a website or system belonging to someone else. You must not configure SiteSurely to target systems you are not authorized to use or test.
5. Passive monitoring and active testing
SiteSurely begins with passive monitoring where supported. Passive monitoring observes public website state and does not, by itself, submit forms, bypass authentication, or take privileged actions.
Active or synthetic testing is separately controlled. The current application requires organization-admin authorization, domain-control verification, and an enabled active-testing setting before active monitors or configured form journeys can run. You must have appropriate authority for the relevant website and system before enabling or requesting active testing. SiteSurely's verification process does not replace your legal or contractual permission to test.
6. Customer responsibilities
You are responsible for your websites, monitoring configuration, target paths, test inputs, account credentials, authorized users, review of alerts and evidence, and compliance with laws and agreements applicable to your use of SiteSurely.
Do not place passwords, payment-card data, government identifiers, or other sensitive information into monitoring fields unless the configuration expressly requires it and you are authorized to do so. The application rejects several sensitive field names for active form-test inputs, but you remain responsible for the information you submit.
7. Acceptable use
You may not use SiteSurely to:
- engage in unlawful, fraudulent, abusive, or deceptive activity;
- monitor or actively test systems without appropriate authorization;
- interfere with SiteSurely, its workers, networks, security controls, or another customer's data;
- introduce malware or knowingly transmit malicious code through the service;
- circumvent authentication, organization boundaries, plan limits, rate limits, or other safeguards;
- attempt to access another organization or user, impersonate another person, or misrepresent your authority;
- use automated activity that places unreasonable load on SiteSurely or the websites it monitors; or
- reverse engineer or copy the service except to the extent a restriction is prohibited by applicable law.
8. Plans, subscriptions, and billing
SiteSurely offers recurring subscription plans. Plan names, prices, site allowances, included features, and any promotional conditions are shown in the application or at checkout and may change for future purchases. The current product includes monthly Starter, Agency, and Scale plans, with a conditional founding offer when displayed and available.
When an organization starts a paid subscription, the organization authorizes Stripe to process the subscription payment and recurring charges according to the selected plan and the payment terms presented at checkout. SiteSurely stores subscription and entitlement metadata needed to operate the plan; Stripe processes payment-card information.
Plan capacity controls the number of client sites eligible for monitoring. Entitlements and plan changes are applied when the billing system confirms them. A plan change may be prorated or invoiced as presented through the billing flow.
9. Renewals, cancellation, and plan changes
Subscriptions are monthly and renew automatically until canceled or otherwise ended. Cancellation is handled through the available SiteSurely/Stripe billing-management flow. A cancellation scheduled through that flow is generally effective at the end of the current billing period, unless the flow or applicable law states otherwise. Until cancellation takes effect, the subscription may continue to provide the applicable entitlement and generate recurring charges.
Owners and administrators are responsible for keeping payment and billing information current. Stripe or SiteSurely may restrict billing actions, monitoring entitlements, or plan changes when a subscription is inactive, unpaid, past due, paused, or otherwise not in a managed paid state.
10. Refunds, credits, and promotions
The current application includes a first-month money-back eligibility workflow tied to the initial monthly payment. Eligibility, timing, request status, and any available amount are determined by the billing records and the terms presented in the application. Later renewals are not included in that first-month workflow.
A refund request is not a promise that a payment will be automatically returned. Refund execution may be disabled or fail closed, and provider processing or settlement may affect timing. Promotional or founding pricing may have additional eligibility, availability, capacity, or one-way-change conditions displayed with the offer.
11. Customer data and monitoring evidence
You retain your rights in content and information you provide or designate for monitoring, subject to the rights needed by SiteSurely and its providers to operate the service. You grant SiteSurely a limited, non-exclusive right to access, transmit, process, store, and display that information as reasonably necessary to provide monitoring, evidence, incidents, reports, notifications, security, support, and related service functions.
SiteSurely may generate screenshots, observations, technical records, check results, evidence, incidents, timelines, and reports from the configured websites. These records are service records intended to help you review observed state. They are not represented as forensic evidence, proof of legal liability, proof of causation, or a guarantee that every relevant event was captured.
12. Privacy
SiteSurely's privacy practices are described in the Privacy Policy at /privacy. If these Terms and the Privacy Policy address the same information-processing topic, the Privacy Policy explains the processing details and these Terms govern use of the service, subject to applicable law.
13. SiteSurely materials and feedback
SiteSurely and its licensors retain rights in the software, interface, service technology, documentation, branding, and other materials that SiteSurely provides. These Terms grant you a limited right to use the service during your authorized subscription or access period; they do not transfer SiteSurely's intellectual property to you.
If you voluntarily submit product feedback, you allow SiteSurely to consider and use that feedback to improve the service without owing you compensation, provided that this does not transfer your unrelated customer data or confidential information.
14. Third-party services
SiteSurely relies on third-party infrastructure and service providers, including providers used for hosting, authentication, storage, billing, email, and monitoring-worker operations. Provider outages, changes, failures, network conditions, or third-party website behavior may affect the service. Your use of a third-party website or provider may also be governed by that provider's own terms.
15. Service changes and availability
SiteSurely may be unavailable or degraded because of maintenance, provider outages, network failures, software defects, browser or website changes, security events, or other circumstances. SiteSurely may modify, discontinue, or replace features over time. No uptime percentage, response time, service credit, or service-level commitment is provided unless SiteSurely expressly agrees to one in a separate written agreement.
16. Security
You must not interfere with SiteSurely's security or authorization controls. SiteSurely uses reasonable technical and organizational safeguards appropriate to the service, but no service can guarantee absolute security. You are responsible for protecting your credentials, limiting organization access, and reporting suspected unauthorized use to support@sitesurely.com.
17. Suspension and termination
SiteSurely may suspend or restrict access when reasonably necessary to address serious Terms violations, unauthorized monitoring or testing, security threats, abuse, unlawful activity, payment failure, or risk to the service or other customers. SiteSurely may terminate access or a subscription when appropriate under those circumstances or when the service is discontinued.
When access ends, you must stop using SiteSurely. Information may remain in service records, backups, provider systems, or security and billing records for periods not specified in these Terms. SiteSurely does not promise a particular export window or permanent preservation period unless separately agreed.
18. Disclaimers
To the extent permitted by applicable law, SiteSurely is provided on an “as available” and “as observed” basis without warranties that the service will be uninterrupted, error-free, complete, secure, or suitable for every purpose. SiteSurely disclaims implied warranties only to the extent the law permits. Nothing in these Terms limits rights or remedies that cannot legally be limited.
19. Liability and legally required limits
To the extent permitted by applicable law, SiteSurely will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost revenue, lost profits, lost business opportunities, lost data, or interruption of business arising from or related to the service. This section does not exclude liability or remedies that applicable law does not permit a contract to exclude.
These Terms do not state a fixed monetary liability cap. Any additional liability allocation, indemnification obligation, governing-law or venue provision, arbitration requirement, class-action waiver, or jury-trial waiver requires a deliberate legal and business decision and qualified legal review before reliance.
20. Changes to these Terms
SiteSurely may update these Terms when the service, business practices, or legal requirements change. The updated version will be posted on this page with a new Last updated date. Material changes may be communicated through reasonable service mechanisms where appropriate. Continued use after an updated version becomes effective may constitute acceptance only to the extent permitted by applicable law.
